The Constitutional Court has final authority to determine whether a difficulty is Constitutional or not; of the Constitution of South Africa. In England and Wales the House of Lords case of Attorney-General v. Blake opened up the risk of restitutionary damages for breach of contract. In this case the income made by a defecting spy, George Blake, for the publication of his book Law news, have been awarded to the British Government for breach of contract. The case has been adopted in English courts, but the situations by which restitutionary damages might be available remain unclear.
